## Privacy Notice & Terms of Use

### Introduction

This Privacy Notice & Terms of Use describes how the extension, COACH by Dropzone AI (the “Extension”), collects, uses, and discloses information when you install and use the Extension. By installing the Extension, you agree to the collection and use of information by Dropzone AI, Inc. (“we,” “us,” “our,” or “Dropzone AI”) in accordance with this Privacy Notice & Terms of Use. If you do not agree to this Privacy Notice & Terms of Use, you are prohibited from installing or using the Extension.

The Extension is designed to analyze alerts present in the active web tab. When you request analysis of a webpage via the Extension, the Extension will receive the domain and the web content to generate guidance specific to the alert being viewed. Note that neither Dropzone nor our LLM providers train on nor retain this information.

### Types of Data Collected

When you use the Extension, we will collect the following information:

- Type of alert (from a small list such as "endpoint" and "phishing")
- Time of processing
- Randomly-assigned unique id (to prevent misuse)
- Standard browser headers such as user-agent
- IP address
- Geolocation

### How We Use Your Data

We use your personal data to:

- Provide the Extension to you for its intended purpose
- Transmit data collected by the Extension to AI applications, and to generate AI alerts and AI suggestions
- For our own internal business purposes (such as to support the Extension, to improve the Extension, to analyze usage trends)
- For legal reasons (such as to enforce our rights, the rights of any third party, and comply with law)

### How We Share Your Data

We may share personal data with:

- Service providers
- AI providers, like OpenAI (with zero retention and no training contracts in place)
- Legal authorities, if required
- Other businesses in the case of business transfers or mergers or acquisitions
- For other purposes, with your consent

### Use of Artificial Intelligence

When you use the Extension, the Extension transmits the content of the URL viewed by the device to us. We will utilize one or more AI LLM APIs, such as OpenAI, to transmit the alert data to an AI LLM as part of the real-time suggestions and analysis. This may include sending personal data and/or sensitive browsing information to an AI LLM, including OpenAI.

OpenAI processes this data on behalf of us under its own policies. OpenAI processes personal data in accordance with the OpenAI Privacy Policy and is offered under its Terms of Use. We are not responsible for OpenAI or how it collects, processes or uses any data that is collected by the Extension and submitted to OpenAI, or for the output that OpenAI generates based on the data transmitted to it from the Extension. OpenAI represents that they do not use inputs submitted by the Extension to train the OpenAI algorithm and do not retain data after processing completes. We are not liable for the use of OpenAI to provide the Extension functionality, and you use the Extension, and OpenAI, at your own risk. We may use other artificial intelligence models from time to time, in addition to OpenAI.

### Retention of Data

We retain your data as needed to fulfill the purposes above or comply with legal obligations. The Extension does not retain the alert, or the AI suggestion and analysis received from OpenAI.

### Your Rights

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, change that information, or delete it. To request to review, update, or delete your personal information, please send a request to coach-support@dropzone.ai.

### Children’s Privacy

The Extension is not intended for individuals under the age of 18 and does not knowingly collect data from individuals under the age of 18.

### Third-Party Links

We are not responsible for the content or privacy practices of external websites.

### License Grant

When you register and install the Extension, we give you the limited, revocable, non-transferrable, non-sublicensable, fully paid right and license to download, install, copy, and execute the extension solely for your own personal use.

### Prohibited Uses

You may not use the Extension in ways that violate OpenAI’s Usage Policies. You also agree not to:

- Violate applicable laws, including those regulating AI and data privacy
- Violate any individual’s rights, including rights of privacy or intellectual property
- Systematically collect data for aggregation or resale
- Mislead, defraud, impersonate, or abuse others
- Interfere with any security features or access controls
- Upload, transmit or use malicious code or spyware
- Disrupt network performance or overload the system
- Reverse engineer, decompile, or copy the Extension software
- Use automation tools without authorization
- Distribute, license, sell or otherwise commercialize the Extension
- Modify, adapt, translate or create derivatives of the Extension
- Exploit the Extension’s functionality to gain an unfair advantage or manipulate online services
- Use the Extension to harass, spam, or conduct unauthorized surveillance
- Use automation, bots, or scripts in conjunction with the Extension for any purpose
- Use the Extension to compete with Dropzone AI

### Compliance with Laws

You agree to comply with all applicable laws, including:

- General Data Protection Regulation (GDPR) – Regulation (EU) 2016/679
- California Consumer Privacy Act (CCPA) – California Civil Code § 1798.100 et seq.
- California Privacy Rights Act (CPRA) – Amendment to the CCPA effective January 1, 2023
- Children's Online Privacy Protection Act (COPPA)
- United Kingdom Data Protection Act 2018
- Personal Information Protection and Electronic Documents Act (PIPEDA) - Canada
- State-level U.S. privacy laws (e.g., Colorado Privacy Act)
- State-level U.S. artificial intelligence laws (e.g., Colorado Artificial Intelligence Act)
- E.U. AI Act - Regulation (EU) 2024/1689

### High-Risk Use Prohibition

Dropzone AI shall not be used for:

- Any use in policing, surveillance, or law enforcement
- Assessments that affect access to essential services (healthcare, education, housing)
- Employment decisions, including hiring, promotion, and termination
- Creditworthiness or financial decisions
- Processing of special category or sensitive data without clear legal basis and explicit consent
- Any high-risk activities or decisions that could lead to significant adverse impacts on individuals

Violations of these prohibitions may result in account termination, data deletion, and legal reporting.

### Disclaimer of Warranties

THE EXTENSION IS PROVIDED “AS IS.” EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE AND OUR AFFILIATES AND LICENSORS MAKE NO REPRESENTATIONS OR WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE EXTENSION, AND DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

### Limitation of Liability

NEITHER WE NOR ANY OF OUR AFFILIATES OR LICENSORS WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER LOSSES.

### Mandatory Arbitration and Class Action Waiver

If a dispute arises out of your use of the Extension, and we are unable to resolve the dispute through informal negotiations, the dispute will be finally and exclusively resolved by binding arbitration under the AAA Commercial Arbitration Rules and, where appropriate, the AAA Consumer Rules. You understand that without this provision, you would have the right to sue in court and have a jury trial. The arbitration may occur in person, by document submission, phone, or online. It will be held in King County, Washington, unless otherwise required by law.
